General conditions

This document establishes the general conditions that form an integral part of the contract stipulated between the occupants of the properties, hereinafter YOU and the company ADF Macaronesian Invest, Sociedad Limitada, with address Calle Candelaria Nº 28 Edificio Olympo Oficina 279, 38003, Santa Cruz de Tenerife, and provided with C.I.F B76748243; hereinafter MACARONESIAN RENT.  

When making a reservation, regardless of the contracting channel (directly through the MACARONESIAN RENT website, through external websites, agencies or tour operators with which MACARONESIAN RENT collaborates); YOU will accept each and every one of the conditions mentioned below.  

  

1.- PRICES AND BENEFITS. The published prices of our accommodations will be specified in euros, by days, weeks or months.  

In principle, the minimum stay is stipulated at 3 nights, however, there are accommodations that exceptionally have another number of minimum nights.  

Extra expenses such as cleaning, additional sheets and towels, air conditioning,  

Heating, cots, high chairs, late check in, late check out, early check in, etc., may not be included in the price, depending on each accommodation and its conditions. If they are not included in the rental price, it will be specified before accepting the reservation conditions and making the reservation; It will also be indicated on the reservation invoice. The rates for extra services are as follows:  

• €25(+ IGIC) extra if check-in takes place between 10:00 p.m. – 8:00 a.m. (late check in). Service that will always be conditioned to availability and acceptance by MACARONESIAN RENT  

• €25 (+ IGIC)extra if check-in takes place between 08:00 a.m. – 1:00 p.m. (early check in). Service that will always be conditioned to availability and acceptance by MACARONESIAN RENT  

• €25 (+ IGIC) extra for providing a baby crib during the stay. Service that will always be conditioned to availability and acceptance by MACARONESIAN RENT  

• €25(+ IGIC) extra for providing a high chair for babies during the stay. Service that will always be conditioned to availability and acceptance by MACARONESIAN RENT  

• €25-30 (+ IGIC) extra (depending on accommodation) if check-out takes place between 11:00 a.m. - 5:00 p.m. (late check-out). Service that will always be conditioned to availability and acceptance by MACARONESIAN RENT.  

  

2.- MODIFICATIONS OF PRICES AND BENEFITS. Prices and services may, in some cases, undergo modifications that will be communicated at the time of booking and confirmed later in writing.  

It could be the case that these modifications occur after the reservation has been contracted and that they will affect essential points of the contract. In that case, you may terminate the contract, free of charge, within a period of five days, and the payment made will be refunded. In this case, the guest does not have the right, in any case, to receive any compensation for this cancellation  

.- CONTRACTING AND PAYMENT CONDITIONS. Reservations can be made through the website https://macaronesianrent.es, by phone at +34 628 54 05 65, or through any of MACARONESIAN RENT's collaborating platforms.  

100% of the booking amount will be paid within a maximum period of 2 Days (48 hours) from the moment of the reservation in the case of reservations managed directly by MACARONESIAN RENT, or within the period stipulated by the collaborating platform through of which the reservation has been made.  

The contracted extras will be paid at the time of reservation or during check-in if MACARONESIAN RENT indicates so in writing, before handing over the keys. These payments can be made by bank transfer, card (VISA OR MASTERCARD) or cash.  

In the event that payment dates are missed by a maximum of 2 calendar days, MACARONESIAN RENT reserves the right to cancel the reservation without prior notice.  

  

4.- CANCELLATIONS. In the event that YOU cancel a booking made directly by MACARONESIAN RENT, this will be subject to the following conditions:  

• From the moment the reservation is made until 30 days before the arrival date: FREE cancellation  

• 29 days before arrival: refund of 50% of the total reservation amount.  

• 7 days before arrival, 100% of the total reservation amount will be charged.  

• In case of a no-show: 100% of the total amount of the reservation will be charged  

• In cancellations due to force majeure, a voucher will be made with a credit equivalent to the amount paid up to the date of cancellation request: credit for the total amount of the reservation up to 29 days before arrival, and credit of 50% of the reservation up to 7 days before entry.  

In case of reservations made through a collaborating platform, the cancellation conditions will be those agreed between YOU and that collaborating platform.  

5.- DEPOSIT. Before your day of arrival, it will be mandatory to provide, through a link that will be sent to you for this purpose, the details of a credit card or to make a deposit of an amount depending on the accommodation, which will be registered as a deposit, to respond to the breach by the occupants of the obligations indicated in these general conditions, as well as possible damages and defects caused in the leased property. If no credit card or deposit is presented, MACARONESIAN RENT reserves the right to prohibit entry into the accommodation, with the tenant losing, in any case, the amounts delivered to MACARONESIAN RENT for the reservation.  

It will be understood that the house is delivered in perfect condition, including furniture and fixtures, at the time of entry if you do not state otherwise in writing at the time of check-in. In the event of damage, MACARONESIAN RENT will be responsible for assessing the damage and charging your credit card or deposit the amount for the replacement, exchange or substitution of the damaged elements without the need for prior authorization from you. In this case, MACARONESIAN RENT will proceed to charge your card within a maximum period of 20 days from the date of departure from the accommodation and will issue an invoice in your name for the total amount of the charge made, sending it by email to the address provided to the time of making the reservation.  

​6.- CUSTOMER OBLIGATIONS AND RULES OF USE. The occupancy of the accommodation will be limited to the number of people indicated in the reservation, counting children and babies as people for the purposes of occupancy. MACARONESIAN RENT may prevent entry to the accommodation in the event of exceeding the permitted number, without generating any right to compensation, or choose to increase the rental price according to the amount it deems appropriate.  

The tenant must respect the following mandatory rules:  

• Please use common sense during your stay at the property.  

• Respect rest hours (10:00 p.m. - 8:00 a.m.).  

• Smoking is only allowed in the outdoor terrace area. Never inside the property or in the bedrooms.  

• Turn off the air conditioning when it is not necessary or when you are not in the house.  

• Events and parties are prohibited during the entire stay.  

• Eating is not allowed on the couches or in the bedrooms.  

• Pets are not allowed.  

• If any damage occurs during your stay, please let us know so it can be fixed before the next guests arrive.  

• The guest must make sure when leaving the accommodation that everything is completely closed (doors and windows).  

• Do not throw garbage or sand in the toilet. Please use the trash can.  

• Only the number of people allowed and declared in the reservation can spend the night in the house. If additional people are not declared, they will have to pay an additional cost in cash at the time of check-in (only if allowed by MACARONESIAN RENT).  

In case of negligence, inappropriate behavior or failure to comply with any of the rules detailed here, MACARONESIAN RENT reserves the right to cancel the rental contract with immediate effect and without prior notice, which may result in the total loss of the deposit and the amount of rent.  

The presence of animals will only be authorized when it has been requested at the time of booking and its acceptance has been confirmed in writing. In the event that it is found that the occupant has introduced one or more unauthorized animals during the stay, MACARONESIAN RENT reserves the right to cancel the rental contract with immediate effect and without prior notice, which may result in the total loss of the deposit. and the rental amount.  

  

7.- MAINTENANCE AND CONSERVATION. The accommodation will be delivered in perfect condition of use and conservation, and its decoration cannot be changed or altered. The return must be made in the same conditions in which it was delivered, so the property must be tidy, with no remains of garbage that must be removed by the occupant. Closets and refrigerators must be emptied.  

In the event that greater dedication is required due to receiving the accommodation in poor condition (due to accumulation of dirt, stained/damaged sheets, blankets and towels, relocation of furniture due to it being moved, etc.) they will be penalized and charged accordingly by credit card:  

• Between €100 and €200 for homes of less than 100m2 or 1/2 rooms.  

• Between €150 and €300 for homes between 100m2 and 200m2 or 3/4 rooms.  

• Between €300 and €500 for homes of more than 150m2 or 4/6 or more rooms.  

These amounts may be charged to the credit card presented by YOU at check-in, or they will be deducted from the deposit.  

In the event of non-return or loss of the keys or control remotes, MACARONESIAN RENT will be forced to deduct from the deposit a minimum amount of 75 euros in the case of keys and €100 for each remote control not returned. In this case, MACARONESIAN RENT will proceed to charge your card within a maximum period of 20 days from the date of departure from the accommodation and will issue an invoice in your name for the total amount of the charge made by sending it by email to the address you provided. he provided us when making the reservation.  

8.- ENTRIES AND EXITS. Entries will be made between 3:00 p.m. and 10:00 p.m., in the event that the property is equipped with an autonomous entry system, you will be provided with the access code and instructions to access the accommodation once the online check-in form has been completed, has made the deposit of the deposit and has provided any additional documentation required by MACARONESIAN RENT. In the event that the property is not equipped with an autonomous entry system and requires delivery of keys in person, we will be waiting for you at the property to give you access at the agreed time for check-in (for this you must indicate the details of the means of arrival (flight/ship number, airport or port, to follow up in case there are unforeseen delays). In this last case, the check-in time can be between 3:00 pm and 09:00 pm. Arivals from 09:00 pm to 11:00 pm will be subject to an extra fee of €25 as “Late check-in". Arrivals from 11:00 pm will be subject to availability and to the payment of this same extra fee.  

Departures will be made before 11:00 am, and you must leave the keys inside the accommodation or back into the key box in case your accommodation has one, and close the door when leaving.  

  

9.- RESPONSIBILITIES ATTRIBUTABLE TO MACARONESIAN RENT. In the event that the reserved accommodation, due to unforeseen causes and not attributable to MACARONESIAN RENT, has a serious unforeseen event and cannot be occupied, MACARONESIAN RENT undertakes to find an alternative solution with similar characteristics and price. If this is not feasible due to lack of available accommodation or because you reject all the proposals offered, all amounts paid will be refunded without you having the right to any compensation for this reason.  

  

10.- INCIDENTS AND CLAIMS. Despite having carefully prepared our catalog and having checked all our accommodations, it may happen that the service is not to your complete satisfaction. In this case, you must notify us within 8 hours from the time of your entry. MACARONESIAN RENT has a customer service/incident service from 8:00 a.m. to 10:00 p.m., and will try to resolve the issues as quickly as possible.  

It is important that the guest assumes and understands that the existence of incidents is inherent to the use of the property and that sometimes its appearance is impossible to foresee (example: problems with septic tank, problems with boilers, broken taps , electrical failures, etc.) and in others they may be beyond our control (example: general power outages, works in the neighborhood, noises from neighbors  

or animals, existence of insects, etc.).  

The MACARONESIAN RENT team is at your disposal throughout the entire period of your stay to resolve all questions and help you enjoy a happy stay.  

11.- EXONERATION OF RESPONSIBILITIES. MACARONESIAN RENT will not assume any responsibility for possible modifications that affect the accommodation or its surroundings that are not directly controllable by MACARONESIAN RENT. The occupant assumes that they will not be able to claim any penalty for the fact that any of the following anomalies exist, provided that they could not be prevented or foreseen by MACARONESIAN RENT:  

Works: Accommodations are generally private properties of various individual owners and are generally located in large residential areas. Accommodations are generally not located in resorts, so, although unlikely, unexpected constructions or public works could potentially occur in the surrounding area. These works are usually carried out by owners, building contractors or government organizations with whom we have no relation and therefore have no influence on these actions. Therefore, the guest assumes when booking their property that neither MACARONESIAN RENT nor the owner of the property have any responsibility for any inconvenience caused by works that are not carried out on behalf of MACARONESIAN RENT.  

Satellite/cable television: If satellite or cable television is indicated in the description, this does not automatically mean that you will be able to receive all the programs you want. The homeowners, mostly foreigners, have decoders that do not always capture all international channels.  

Water, electricity and Internet: Water, electricity and Internet supply cuts are not common. However, municipal and/or regional authorities, for different reasons, may agree to temporarily cut off or limit distribution on certain times. Under no circumstances can MACARONESIAN RENT be held responsible for any inconvenience or damage caused.  

12.- DATA PROTECTION. The personal data provided by the tenant in the contact form and/or reservation form will be incorporated into a file whose ownership corresponds to MACARONESIAN RENT. The purpose of their collection and processing is the administrative management of the requested service, the maintenance of established commercial relationships, as well as keeping you informed of new services and offers. In compliance with current regulations,  

MACARONESIAN RENT guarantees that it has adopted the necessary measures and techniques to maintain the level of security required in response to the nature of the personal data processed. Likewise, we inform you that you can exercise your rights of access, rectification, cancellation and opposition, regarding your personal data, by sending a letter, accompanied by your ID, to the address indicated on the reservation voucher.  

MACARONESIAN RENT will not transfer or communicate the data stored in its files to third parties, except in those cases in which said communication is authorized by the user, required by current legislation or is necessary for the provision of the requested service.  

  

13.- BREACH OF THE GENERAL CONDITIONS. In any case, MACARONESIAN RENT reserves the right to cancel the rental contract with immediate effect and without prior notice, which may result in the immediate expulsion of the guest from the home, the total loss of the deposit and the rental amount in the event of breach of some of the general conditions included in this document.  

  

14.- APPLICABLE LEGISLATION AND JURISDICTION. In all matters that are not provided for in these conditions, Spanish legislation, as well as regional regulations, will apply in any case. The parties, expressly waiving any jurisdiction that may apply to them by law, submit to the jurisdiction and competence of the courts and tribunals of the city of Santa Cruz de Tenerife for the resolution of any issue arising from the application and interpretation of this contract.  

  

Language: The whole text of the present Contract, as well as the documents derived from it, including those in the Annexes, have been written in Spanish and English, both versions being deemed authentic, but for legal purposes the text in Spanish is to be given priority of interpretation.
